1. Vehicle Rental Agreement

All rentals are subject to a separate, detailed Rental Agreement provided at booking or collection. This agreement outlines specific terms, insurance, charges, and your obligations. In case of conflict, the Rental Agreement prevails.

2. Eligibility and Requirements

To rent a vehicle from Totnes Vehicle Hire, you must:

Be at least 21 years old (age restrictions may apply for certain vehicles or drivers under 25).
Hold a valid, full driving license for the vehicle category, held for a minimum period (e.g., 12 or 24 months).
Provide valid identification and proof of address.
Provide valid payment information for rental charges and a refundable security deposit.
Meet any other criteria specified in the Rental Agreement.

3. Booking and Payment

Bookings can be made online, by phone, or in person at our Totnes location.
A booking deposit may be required.
Full payment and a refundable security deposit are typically due at vehicle collection.
All prices are in Great British Pounds (£) and include VAT where applicable.
We accept major credit/debit cards, processed securely by third-party providers.

4. Vehicle Condition, Collection, and Return

Inspect the vehicle upon collection and report any existing damage immediately. A condition report will be signed.
Return the vehicle in the same condition, allowing for fair wear and tear. New damage will be charged against your deposit or insurance.
Return the vehicle with the same fuel level as collected to avoid refuelling charges.
Late returns may incur additional charges. Please contact us if you anticipate a delay.
You are responsible for all fines (parking, speeding, congestion) incurred during the rental period. An administration fee may apply.

5. Insurance and Liability

Basic third-party insurance is included. Full details, including excess amounts, are in the Rental Agreement.
Additional insurance options are available to reduce your liability for damage or theft.
You are responsible for damage or loss up to the insurance excess, unless otherwise covered.
Damage caused by negligence, misuse, or breach of terms is your responsibility, regardless of insurance.

6. Cancellations and Amendments

Cancellation and amendment policies vary. Refer to your booking confirmation or Rental Agreement for details. Late cancellations or no-shows may result in deposit forfeiture or additional charges.

7. Prohibited Uses

You agree not to use the rented vehicle for:

Any illegal purpose or activity.
Racing, rallying, off-roading, or hazardous activities.
Transporting hazardous, flammable, or explosive materials.
Sub-renting or allowing unauthorized drivers.
Driving under the influence of alcohol or drugs.
Any purpose for which the vehicle is not designed.
Carrying more passengers than legally licensed.
Driving outside agreed geographical limits (e.g., outside the UK without European cover).

Breach of these terms may lead to immediate termination of the rental agreement and additional charges.

8. Limitation of Liability

To the extent permitted by English law, Totnes Vehicle Hire is not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenues, data, or goodwill. Our total liability for any claim related to these Terms or your use of services will not exceed the amount you paid us in the preceding 12 months. This does not limit liability for death or personal injury caused by our negligence, or for fraud.

9. Governing Law and Jurisdiction

These Terms and any disputes arising from them are governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales will have exclusive jurisdiction over any such disputes.

10. Changes to Terms

We may modify these Terms at any time by posting revisions on our website. Your continued use constitutes acceptance of the new Terms. We encourage you to review them periodically.
